Terms and Conditions for the use of qrvibes.com

§ 1 Scope and provider

These Terms and Conditions apply to the use of the website qrvibes.com, including all language versions (e.g. de.qrvibes.com) and the short domain qrvib.es, and all functions offered there (together “qrvibes.com”).

The provider is Christoph Neumüller, Steinweg 1, 94569 Stephansposching, Germany, email: info@qrvibes.com (hereinafter “we”). Further details can be found in the imprint.

These Terms and Conditions apply to all users of qrvibes.com, including everyone who uses qrvibes.com without a user account, for example to create QR codes or to create short links with the URL shortener. By using qrvibes.com you accept these Terms and Conditions; on the URL shortener page we point this out before a short link is created.

Deviating terms of users (hereinafter “you”) do not apply, even if we do not expressly object to them.

§ 2 Services of qrvibes.com

qrvibes.com offers, among other things, a generator and a scanner for QR codes and barcodes, print templates, a bulk generator, a URL shortener and, for signed-in users, saving codes, dynamic QR codes, short links with rules and scan and click statistics. Which functions are available without signing in and which only with a user account is shown in the overview on the home page.

The use of qrvibes.com is free of charge. Should we offer paid services in the future, separate terms will apply to them, which you must expressly accept beforehand. Existing free functions will not become chargeable as a result without your consent.

There is no entitlement to particular functions or to constant availability of qrvibes.com. We strive for trouble-free operation but cannot rule out interruptions, for example due to maintenance, technical faults or outages at our hosting provider.

We may change, extend, restrict or discontinue functions. If this causes data in user accounts to be deleted or dynamic QR codes and short links to stop working, we will inform affected users by email at least 4 weeks in advance.

§ 3 User account and conclusion of contract

Many functions can be used without a user account. For further functions you can create a user account free of charge. Upon registration and acceptance of these Terms and Conditions, a free contract of use is concluded between you and us.

You must be at least 18 years old to register. Persons under 18 may not create a user account, not even with the consent of their parents or legal guardians. If we learn that an account has been created by a person under 18, we may delete it.

You must provide your own valid email address at which we can reach you. You may also use a pseudonym as your name.

Keep your password secret and protect it from access by third parties. If you suspect that someone knows your password, please change it immediately under “My account” and let us know.

A user account is not transferable.

§ 4 Confirmation of the email address

After registration we send you an email with a confirmation link. By clicking the link you confirm that the email address you entered belongs to you. Until it is confirmed, we display a notice under “My account”, where you can also request the email again.

If the email address is not confirmed within 3 weeks of the first confirmation email being sent, the user account and all data stored in it (e.g. codes, dynamic QR codes, short links, reply forms and statistics) will be deleted automatically and permanently.

§ 5 Deletion of inactive user accounts

User accounts that nobody has signed in to for 2 years will be deleted automatically and permanently together with all data stored in them. The last sign-in is decisive; an automatic sign-in via “Stay signed in” also counts.

About 30 days before deletion you will receive a reminder at your email address. If you sign in by the date stated there, your account will be kept and the period starts again.

Please note: after deletion, dynamic QR codes and short links from the account will no longer redirect, even if they have already been printed or published.

§ 6 Permitted use

The following rules apply to all users, with and without a user account, and in particular also to short links created without signing in.

You are responsible for the content you enter in QR codes, barcodes, short links, templates and reply forms or to which they link. In particular, you may not use qrvibes.com to

  • link to unlawful content, content harmful to minors, insulting content or content inciting hatred,
  • enable fraud, phishing or the theft of access or payment data,
  • distribute malware or circumvent security warnings,
  • infringe the rights of third parties, e.g. trademarks, copyrights or personality rights,
  • distribute unsolicited advertising (spam) or disguise the origin of links in order to bypass filters.

It is also not permitted to query qrvibes.com automatically to an extent that impairs its operation, to circumvent security measures or to create large numbers of user accounts.

You can report suspicious codes and links to us using the report form.

§ 7 Dynamic QR codes and short links

Dynamic QR codes and short links lead to the stored destination via our server (e.g. qrvib.es/…). They only work as long as the code or short link and – for saved codes – your user account exist and qrvibes.com is operated. Expired short links are deleted 30 days after expiry.

If there is a justified suspicion of a violation of § 6, we may display a warning page before the redirect, block the redirect or delete the code or short link. For codes and short links in a user account we will inform you of this where possible and give you the opportunity to comment. Short links created without signing in may be blocked or deleted without prior notice in the event of a violation.

Anyone who distributes unlawful content via qrvibes.com is liable to us for any resulting damage and shall indemnify us against claims asserted against us by third parties because of this content. If criminal offences are suspected, we may pass on the available data to the competent authorities.

§ 8 Rights to content

You may use the QR codes and barcodes you create without restriction, including commercially. You retain all rights to the content you enter or upload (e.g. texts, photos and logos). You grant us only the rights necessary to store, display and forward this content for you. You warrant that you hold the rights required for this.

The content, texts, graphics and templates of qrvibes.com itself are protected by copyright. You may use templates for your own codes and printed matter. Excluded are the open-source libraries, fonts, flag graphics and icons used; they are subject to their own licenses, which are listed in the imprint under “Open-source licenses”.

§ 9 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.

As we provide our services free of charge, our liability is otherwise excluded to the extent permitted by law. This applies in particular to the loss of stored data, to failures of dynamic QR codes and short links and to damage caused by a code not being readable by a particular device. Please test your codes with several devices before printing and back up important data using the data export under “My account”.

The notices we display for scanned links (e.g. about unencrypted connections or unusual domain names) are simple automatic checks. They do not replace your own judgement and are no guarantee that a link is safe.

The operators of third-party websites to which codes or links refer are solely responsible for their content.

§ 10 Term, termination and suspension

The contract of use runs for an indefinite period. You can terminate it at any time without notice by deleting your user account under “My account”. All stored data will be removed immediately.

We may terminate the contract by email with 4 weeks’ notice. The right to terminate without notice for good cause remains unaffected; good cause exists in particular in the event of a serious or repeated violation of § 6. In this case we may also suspend the account temporarily.

Automatic deletion under §§ 4 and 5 also ends the contract.

§ 11 Data protection

How we handle your data is described in our privacy policy.

§ 12 Changes to these Terms and Conditions

We may change these Terms and Conditions if there is an objective reason, such as new functions or changes in legislation or case law. We will notify registered users of changes by email at least 4 weeks before they take effect.

If you do not agree with the changes, you can delete your account at any time until they take effect. Material changes that restrict your rights only become effective with your express consent; without consent, the previous version continues to apply or we terminate the contract in accordance with § 10.

§ 13 Applicable law and dispute resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection of mandatory provisions of the country in which you have your habitual residence.

If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered office of the provider.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, you can reach us via the contact form.

§ 14 Final provisions

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

The German version of these Terms and Conditions is authoritative. This English version is a translation provided for your convenience.
